Welcome to Seagreen Nutrition. The terms "we," "us," and "our" refer to Seagreen Nutrition. Seagreen Nutrition operates this store and website, including all related information, content, features, tools, products and services (the "Services"). Seagreen Nutrition is powered by Shopify.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use our Services.
SECTION 1 — ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You are solely responsible for maintaining the security of your account credentials and all account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 — OUR PRODUCTS
We have made every effort to provide an accurate representation of our products. Colors or product appearance may differ from how they appear on your screen. We do not warrant that the appearance or quality of any products will meet your expectations.
All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities offered to any person, geographic region, or jurisdiction.
SECTION 2A — HEALTH AND SUPPLEMENT DISCLAIMER
The products sold through our Services are dietary supplements and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. These statements have not been evaluated by the Food and Drug Administration.
Our products are not intended as substitutes for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider before beginning any supplement regimen, particularly if you are pregnant, nursing, taking medications, or have a pre-existing medical condition.
Individual results from use of our products may vary. Results depend on a variety of factors including but not limited to age, health status, diet, exercise, and other lifestyle factors. Any testimonials or reviews reflect individual experiences and are not guaranteed outcomes.
We make no representations that our products are appropriate or available for use outside the United States. Those who access our Services from other locations do so at their own risk and are responsible for compliance with local laws.
SECTION 2B — NOTICE TO CALIFORNIA RESIDENTS
Our products have not been evaluated for compliance with California's Safe Drinking Water and Toxic Enforcement Act of 1986 (Proposition 65). We currently do not ship to California residents. If you are a California resident, please do not place an order through our website. Any order placed by a California resident will be cancelled and refunded.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. Seagreen Nutrition reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Seagreen Nutrition confirms acceptance.
Please review your order carefully before submitting. Seagreen Nutrition may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, change, or cancel an order, we will attempt to notify you by contacting the email, billing address, or phone number provided at the time the order was placed.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
SECTION 4 — PRICES AND BILLING
Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and will be confirmed in your order confirmation email. Posted prices do not include taxes, shipping, or handling charges unless expressly stated.
You agree to provide current, complete, and accurate purchase and payment information for all purchases. You represent and warrant that the payment information you provide is true, correct, and complete, and that you are duly authorized to use such payment method.
SECTION 5 — SHIPPING AND DELIVERY
We currently ship to 49 U.S. states. We do not ship to California. We are not liable for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, weather, or events outside our control. Once products are transferred to the carrier, title and risk of loss passes to you.
We are not responsible for packages that are lost, stolen, or damaged after delivery confirmation. If your package is lost or damaged in transit, please contact the shipping carrier directly.
SECTION 6 — RETURNS AND REFUNDS
All return and refund requests are handled on a case by case basis at the sole discretion of Seagreen Nutrition. We do not guarantee refunds or exchanges. To initiate a return inquiry, contact us at support@seagreennutrition.com within 30 days of delivery. We reserve the right to decline any return request that does not meet our criteria.
Returned products must be unused, in original packaging, and in resaleable condition. Shipping costs for returns are the responsibility of the customer unless the return is due to our error. Refunds, if approved, will be issued to the original payment method within 10 business days of receiving the returned product.
We are not responsible for returns that are lost or damaged in transit.
SECTION 7 — INTELLECTUAL PROPERTY
All trademarks, brands, text, images, graphics, and content on our Services are owned by Seagreen Nutrition or its licensors and are protected by U.S. and foreign intellectual property laws. You may not reproduce, distribute, modify, or use any of our content without prior written consent.
SECTION 8 — THIRD PARTY LINKS
Our Services may contain links to third party websites. We are not responsible for the content, accuracy, or practices of any third party sites. Access to third party sites is at your own risk.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
Seagreen Nutrition is powered by Shopify. Any sales and purchases made in our store are made directly with Seagreen Nutrition. Shopify is not responsible for any aspect of sales between you and Seagreen Nutrition. You expressly release Shopify and its affiliates from all claims arising from your purchases and transactions with Seagreen Nutrition.
SECTION 10 — PRIVACY POLICY
All personal information collected through our Services is subject to our Privacy Policy at seagreennutrition.com/policies/privacy-policy. By using our Services you acknowledge that you have read and agree to our Privacy Policy.
SECTION 11 — FEEDBACK
By submitting any feedback, reviews, or suggestions to Seagreen Nutrition, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such feedback for any purpose including commercial use. You represent that you own all rights to any feedback submitted and that it complies with these Terms.
SECTION 12 — DISPUTE RESOLUTION AND ARBITRATION
Please read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the use of our Services or products — including questions of arbitrability — shall be resolved exclusively through binding individual arbitration rather than in court, except as set forth below.
Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org. The arbitration will take place in Bergen County, New Jersey, or by telephone or video conference at our discretion. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the fullest extent permitted by law, you waive any right to bring or participate in a class action lawsuit, class-wide arbitration, private attorney general action, or any other representative proceeding against Seagreen Nutrition.
Exceptions. Either party may bring an individual claim in small claims court. Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Opt-Out. You may opt out of this arbitration agreement by sending written notice to legal@seagreennutrition.com within 30 days of first agreeing to these Terms. Your notice must include your name, address, and a clear statement that you wish to opt out of arbitration.
SECTION 13 — PROHIBITED USES
You may use our Services for lawful purposes only. You may not use our Services to violate any law, infringe intellectual property rights, transmit harmful or misleading information, impersonate any person or entity, or engage in any conduct that restricts others' use of the Services.
SECTION 14 — AGENTS
No automated agent, AI tool, or software may access, use, or interact with our Services without identifying itself in all HTTP/HTTPS requests and operating in strict compliance with our technical requirements. We reserve the right to limit or block any agent access to our Services.
SECTION 15 — TERMINATION
We may terminate your access to our Services at any time without notice at our sole discretion. You remain liable for all amounts due through the date of termination.
SECTION 16 — DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
SECTION 17 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, SEAGREEN NUTRITION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR PERSONAL INJURY, ARISING FROM YOUR USE OF OUR SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 90 DAYS PRECEDING THE CLAIM.
SECTION 18 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Seagreen Nutrition, its officers, directors, employees, agents, and licensors from any claims, damages, losses, liabilities, and expenses — including reasonable attorneys' fees — arising from your breach of these Terms, your violation of any law or third party rights, or your use of our Services or products.
SECTION 19 — GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law provisions. Subject to the arbitration agreement in Section 12, you consent to the exclusive jurisdiction of the state and federal courts located in Bergen County, New Jersey for any disputes not subject to arbitration.
SECTION 20 — SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
SECTION 21 — WAIVER AND ENTIRE AGREEMENT
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms constitute the entire agreement between you and Seagreen Nutrition regarding your use of our Services and supersede all prior agreements.
SECTION 22 — ASSIGNMENT
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. We may assign these Terms without restriction.
SECTION 23 — CHANGES TO TERMS
We reserve the right to update these Terms at any time. Material changes will be communicated to you in accordance with applicable law. Your continued use of our Services following any changes constitutes acceptance of the updated Terms.
